Privacy Policy Sindudas.org

OBJECTIVE

This privacy policy discloses the privacy practice of Sindudas.org and explains how your personal information is used.

It states obligations which the Personal Information Protection law sets out for the data controller. The policy follows data protection terms stated in the Organic Law 15/1999, 13 December; of the Personal Information Protection Act (LOPDCP), and Law 34/2002, 11 July, about the Services of the Association for Electronic Information and Commerce (LSSICE). It explains your rights as the information holder, and how to exercise them.

ACCEPTANCE

Access, navigation, and registry on www.sindudas.org imply the user is familiar with, acts accordingly to, and accepts what is set out in the Privacy Policy established by the Fundación Triángulo Madrid.

PERSONAL AND MATERIAL POLICY APPLICATION SCOPE

The Privacy Policy is applied to: individuals, corporate bodies, and unincorporated entities that have direct or indirect access to the Fundación Triángulo Madrid´s information processing procedures. These persons are, by way of information and by no means limited to: the data controller, members of the directive and administrative branch, and users of www.sindudas.org.

Fundación Triángulo ´s privacy policy extends to the information systems used by the data controller, people in charge of processing information; public or private communication infrastructures, and the primary services they provide.

The Fundación Madrid is the data controller for information gathered from: forms filled out on www.sindudas.org; information collected from answering forms, coupons, print-outs etc; and information gathered from emails received, or created through connections with personal computers, etc.

The Fundación Triángulo Madrid uses the personal information you give us voluntarily to send out information you´ve requested, send organization-related email notifications, and supply on-line information.

USER INFORMATION RIGHTS

The Fundación Triángulo Madrid clearly states to users, by way of various information channels (electronic, web, etc.,) who the data controller is, identification information, registered address, and contact information. The Fundación Triángulo specifies that as the user, along with the right of protection of personal information, you have the right of access, rectification, cancellation and objection. We indicate which department or area you must contact to exercise your rights, and how to exercise them. We also specify the purpose of information processing.

TRUTHFUL INFORMATION AND UPDATING INFORMATION

The Fundación Triángulo Madrid assumes that the user is giving us truthful personal information, over the different channels of communication. We assume it is you providing your information, that you are who you say you are, that you are giving us updated information, and that you will let us know of any modification of your information as it comes up.

Those persons that come in contact and deal with the processing of personal information concerning individuals, and who have indirect or direct access to files, at all times observe the obligation of secrecy concerning personal information given to them in the course of their work. The Fundación Triángulo Madrid regards the duty to secrecy as a fundamental obligation of the organization as well as its administrative and directive branches.

The duty to secrecy is maintained even after the relationship with the Fundación Triángulo Madrid, the data controller, is no longer intact.

CONSENT TO DATA PROCESSING

The Fundación Triángulo Madrid processes your personal information, and adds it to our files when you accept to provide us with your information, thus expressly giving your consent to do so.

Services provided by the Fundación Triángulo Madrid are meant for adults of legal age in Spain. The Fundación Triángulo assumes that you are of adult age, when you give us your information.

RIGHTS OF ACCESS, RECTIFICATION AND CANCELLATION

Under the Data Protection Act you have fundamental right to Access, Rectification and Cancellation of your personal information. These rights are of a very personal nature, and can only be exercised by you, or someone else in your name, when they concur with circumstances set out in the Protection of Personal Information act.

Through the right to Access, you can obtain information relative to your personal information: knowing if that information is available to the data controller; what your information will be used for; the origin of your information, and communications already made or those anticipated.

The right to Rectification allows you to ask for your personal information to be changed or completed, if incorrect or incomplete.

By exercising your right of Cancelation, you can ask to have inadequate or excessive personal information erased. Upon doing so, the Fundación Triángulo Madrid will uphold legal provisions requiring data conservation.

RIGHT TO OBJECT

You have the right to object to the use of your personal information by the data controller or data processor, processed for different objectives. The Fundación Triángulo Madrid informs users why we are asking for your personal information, and give you the option to object to data processing and/or revoke your given consent to use your information.

Given the transnational nature of our activity, personal information provided to the Fundación Triángulo Madrid could be stored in servers in other countries in the European economic space which have data protection laws equal to the Spanish Personal Information Protection and Processing law; and in servers found in the US, which is compliant with the Safe Harbour Privacy Principles.

RECOMENDATION OF OTHER WEBSITES

When the Fundación Triángulo Madrid recommends or links another site through www.sindudas.org, it is because we think it will be of interest to the user/client. The Fundación Triángulo Madrid does not have the obligation to oversee websites or pages it recommends. Those websites have created legal entities, individuals or unincorporated entities separate in their entirety, from the Fundación Triángulo of Madrid. We do not intervene in the administration, finances, content of these sites; nor do we administer or participate in services provided by sites/pages we have recommended.

The Fundación Triángulo Madrid will annul any link or will refuse to recommend a page or site when there is irrefutable proof that services offered on recommended link/site are illicit or infringe on the rights of third parties susceptible to indemnity.

The Fundación Triángulo Madrid uses security measures required by the Personal Information Protection law, in all work centers, business centers, systems, communications infrastructures, etc. The Fundación has also adopted logical, physical, organizational, contractual, etc measures to avoid all unauthorized third party access to information or the destruction, modification, reproduction, disclosure, transmission or reuse of said information.

VALIDITY AND MODIFICATION OF PRIVACY POLICY

The privacy policy established by the Fundación Triángulo Madrid entered into effect the date of its publication on www.sindudas.org, and as the user/client you can save and use it. The Fundación Triángulo Madrid is authorized to modify its privacy policy, advising the user/client through www.sindudas.org.

GLOSSARY OF TERMS

Concerned or interested party: The individual whose personal information will be processed.

Cancellation: Procedure by virtue of which the responsible party ceases to use the information. Cancellation implies that the information will be blocked, consistent with the rights of the information holder to impede processing, except by state administration agencies, judges and courts, to address any responsibilities ensuing from processing, and only during the statute of limitations placed on said responsibilities. After this statute is no longer valid, user should proceed to the deletion of information.

Cession or transfer of information: Processing of information that implies disclosure to a person other than the concerned party.

Consent of the interested party: All unequivocal statements of voluntary, specific and informed free will by which the concerned party consents to processing of their personal information

Personal information: Any numerical, alphabetical, graphic, photographic, acoustic or any other type of indentified and identifiable information pertaining to an individual

Addressee or transferee: Individual or legal entity, public and/or private and administrative organism information is released to. This could also be an unincorporated entity acting as a separate party.

Entity in charge of managing data processing: Individual or legal entity, public or private and administrative organisms that, acting alone or in conjunction with others, processes personal data on behalf of party responsible for data processing or files, due to an established legal relationship linking the two, and defining the scope of its actions to provide service.

Exporter of personal information: Individual or legal entity, public or private or administrative organism in Spanish territory that performs, in accordance with norms set out under the present regulations, a transfer of information of a personal nature to a third country.

Files: All collected organized data of a personal nature, which allows access to the information under agreement of determined criteria, regardless of the form or manner of creation, storage, organization and access.

Resources with public access: All files which can be seen by anyone, without limitations or demands than in the case of the payment of consideration. These include resources of public access, exclusively the promotional census, telephone indexes under terms set out for their specific regulations, and lists of people pertaining to professional groups containing only name, title, profession, activity, academic standing, address and indication of belonging to the group. Likewise, newspapers and official bulletins and media, are also of public access.

Importer of personal information: Individual or legal entity, public or private, and administrative organism receiving information via international transfer from a third country, being responsible for the processing, managing of processing, or a third party processing of information.

Information System: A collection of documents, processes, programs, media and equipment used to process personal information.

Medium: Physical objects to store or keep information or object to be processed in an information system and where information can be recorded and kept.

International information transfer: Processing of information that involves a transfer of said information outside the European Economic Space; a cession or communication of information, with the purpose of processing information by data controller established in Spanish territory.

Personal information processing: Any technical procedure or operation, automated or otherwise, that allows for the gathering, recording, maintenance, development, query, blockage or deletion; as well as the collection of personal information via communication, searches, interconnections and transferences.
